Doesn't that violate the equal protection clause and the first amendment?

The first amendment says your rights can't be stripped as a result of speech. One of those rights is that the law need to treat you as a victim of a crime the same as someone else. The state can't just label someone as having no protections of law.

But it's also a jury that did it and they have the ability to nullify.
