Though to be fair Daniel Penny and Kyle Rittenhouse were dealing with immediate physical threats. It's a good case for the Norwegian model of issuing citations instead of arrests for almost anything. The US constitution is supposed to make it impossible for the government to punish you in any dimension without a trial. Sometimes these judges will accept arguments that there is a need or a public interest to do something else, but the point of the constitution is to give the government power to pursue a need or public interest... within the granted powers and limitations.
If they had just given him a citation Derek Chauvin wouldn't be in jail. That's a nice perk to actually following the constitution.
