It was found by courts that when the FBI directed social media companies to silence people over covid and political views, using a third party to engage in an activity the government was prohibited to do, this was a violation of the First Amendment.
The courts can use this logic again. The government cannot use third parties to legalize its actions it alone can't do. This is settled law. But the government will always pretend they didn't understand these concepts until the courts clarify on every individual matter.
This is going to continue until violating the constitution comes with criminal penalties. Can the constitution be the highest law of the land if it can be violated without severe consequences?

The Supreme Court just declined to rule on this so govt gets to keep doing the surveillance on citizens. Cameras on public are even better.
So the NSA's survailence is limited to foreign operations. The issue is where domestic and foreign blur, the NSA was taking advantage to spy on domestic. And then it kept growing.
